These Terms of Service ("Terms") govern your access to and use of the website at protocolsbyjames.com, the web application at app.protocolsbyjames.com, and any coaching or mentorship services we provide (collectively, the "Services"). By creating an account or paying for any Service, you agree to be bound by these Terms.
1. Who we are
Protocols by James is a sole proprietorship operated by James Quilter, offering online fitness coaching and coach mentorship. You can reach us at protocolsbyjames@gmail.com.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are 18 or older, have the legal capacity to enter into these Terms, and will comply with all applicable laws.
3. The Services
3.1 Coaching subscriptions
We offer recurring, monthly fitness coaching subscriptions at three price tiers (Starter, Pro, and Elite). Each subscription includes a personalized training program, nutrition guidance, and periodic check-ins, with features varying by tier as described on the Coaching page. Coaching is delivered digitally through app.protocolsbyjames.com.
3.2 Coach mentorship
We also offer 1-on-1 mentorship for individuals who want to become fitness coaches. Mentorship is scoped and priced per client and is typically billed via invoice.
4. Health & fitness disclaimer
Protocols by James is not a medical provider, and the Services do not constitute medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before beginning any exercise or nutrition program, especially if you have any pre-existing medical conditions, are pregnant, or are taking any medication. You assume all risks associated with physical activity and dietary changes. If you experience pain, dizziness, or any adverse symptoms, stop immediately and consult a physician.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at protocolsbyjames@gmail.com if you suspect unauthorized access.
6. Payments & billing
Payments are processed by LemonSqueezy (Lemon Squeezy, LLC), our merchant of record. By subscribing, you authorize LemonSqueezy to charge your payment method on a recurring monthly basis at the rate displayed at checkout, plus any applicable taxes, until you cancel. Prices are in U.S. dollars.
Your subscription renews automatically each month. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.
Refunds are governed by our Refund Policy.
7. Acceptable use
You agree that you will not:
- Share your account, training plans, meal plans, or other materials with any third party without written permission.
- Reverse engineer, resell, or redistribute any portion of the Services.
- Use the Services for any unlawful, harassing, or harmful purpose.
- Upload content you do not have the right to share, or content that infringes any third-party rights.
8. Intellectual property
All training programs, meal plans, written materials, graphics, and other content provided through the Services are the property of Protocols by James and are licensed to you for your personal, non-commercial use only. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. User content
You may submit photos, metrics, and messages to your coach through the Services ("User Content"). You retain ownership of your User Content and grant us a limited license to use it solely to deliver the Services to you (for example, to review your check-in photos and provide coaching).
10. Termination
You may cancel your subscription at any time. We may suspend or terminate your access to the Services at our discretion if you materially breach these Terms, use the Services in a way that harms other users or us, or engage in fraudulent activity.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ANY SPECIFIC FITNESS, WEIGHT-LOSS, OR PERFORMANCE RESULTS. INDIVIDUAL RESULTS VARY BASED ON GENETICS, ADHERENCE, AND MANY OTHER FACTORS OUTSIDE OUR CONTROL.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROTOCOLS BY JAMES AND ITS AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Protocols by James from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Services.
14. Governing law
These Terms are governed by the laws of the State where the business is operated, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in that jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services. Your continued use of the Services after the effective date of updated Terms constitutes acceptance.
